These Affiliate Terms & Conditions (“Agreement”) govern participation in the Claymoo Affiliate Program (“Program”). By signing up or participating, you (“Affiliate”) agree to comply with the following terms.

1. Enrollment in the Program

1.1. Eligibility

• You must be at least 18 years old and legally capable of entering into a contract.

• You must have an active social media presence or website that aligns with Claymoo’s brand values.

1.2. Approval & Termination

• Claymoo reserves the right to accept or reject any affiliate application for any reason.

• Claymoo may terminate your participation at any time if you violate these terms.

2. Affiliate Responsibilities

2.1. Content Creation Requirements

• Affiliates must create and post at least one (1) video featuring Claymoo products within 30 days of joining the program.

• Content must include clear visuals and positive messaging about Claymoo.

• Additional content (e.g., Instagram posts, TikToks, blog posts) must follow Claymoo’s brand guidelines.

2.2. Exclusivity & Restrictions

• Affiliates must not promote direct competitors of Claymoo while active in the Program.

• Any sponsored content must be approved by Claymoo before posting if requested.

2.3. Posting & Removal Policy

• Affiliates must not delete or remove any Claymoo-related content for at least 12 months after posting.

• Any content removal requires written approval from Claymoo.

3. Ownership & Data Rights

3.1. Ownership of Content

• All content created under this program, including videos, images, captions, and written reviews, becomes the exclusive property of Claymoo upon posting.

• Claymoo reserves the right to edit, redistribute, and use affiliate content for any commercial, marketing, or advertising purposes indefinitely.

3.2. Data & Performance Rights

• Claymoo owns all data related to the performance of the affiliate’s content, including engagement, views, conversions, and customer insights.

• Affiliates must provide performance metrics if requested.

4. Commission & Payments

4.1. Commission Structure

• Affiliates earn commission on qualifying sales tracked through their unique referral link or code.

• Commissions are subject to change at Claymoo’s discretion with prior notice.

4.2. Payouts via Social Snowball

• Payments are processed through Social Snowball, subject to their terms and conditions.

• Affiliates must ensure their Social Snowball account is properly set up to receive payouts.

• Payments are made through the Social Snowball platform

• Fraudulent, refunded, or canceled sales are not eligible for commission payouts.

5. Compliance & Legal Obligations

5.1. Compliance with Advertising Standards

• Affiliates must comply with all Canadian advertising regulations, including the Competition Act and Ad Standards Canada guidelines.

• Any paid promotion must include clear disclosure, such as #ad or #sponsored.

5.2. Indemnification

• Affiliates agree to hold Claymoo harmless from any legal claims arising from their participation in the program.

5.3. Governing Law & Jurisdiction

• This Agreement is governed by the laws of Ontario, Canada.

• Any disputes must be resolved in a court located in Ontario, Canada.

6. Program Modifications & Updates

• Claymoo reserves the right to update or modify these terms at any time.

• Affiliates will be notified of any major changes via email or through their Social Snowball dashboard.

By participating in the Claymoo Affiliate Program, you acknowledge and agree to these terms.
